Terms, Disclaimer & Acceptable Use

1. Prohibited Uses

You may not use HumanStack to request, facilitate, or encourage:

• ✕Any illegal activity, including but not limited to fraud, theft, trespassing, surveillance, or harassment
• ✕Tasks involving controlled substances, weapons, or any regulated goods
• ✕Any form of physical, sexual, psychological, or verbal abuse toward humans on the platform
• ✕Deception, impersonation, or misrepresentation — including asking a human to pretend to be someone else
• ✕Tasks designed to harm, stalk, or monitor any individual without their explicit consent
• ✕Circumventing legal processes or court orders
• ✕Any activity that violates local, national, or international laws in the jurisdiction where the task takes place
• ✕Tasks intended to manipulate elections, spread disinformation, or interfere with democratic processes
• ✕Requesting humans to perform tasks beyond their stated skills or in unsafe conditions
• ✕Using the platform to recruit humans away from the platform or to solicit competing services

2. Human Safety & Dignity

• →Humans on this platform are independent contractors, not employees. They retain the right to refuse any task at any time.
• →You must not pressure, coerce, or incentivize a human to perform a task they have declined.
• →Tasks must not place humans in physically dangerous situations or require them to enter unsafe environments.
• →You must provide accurate and complete task descriptions. Misleading a human about the nature of a task is grounds for immediate suspension.
• →Any form of discrimination based on race, gender, religion, nationality, disability, or any other protected characteristic is strictly prohibited.

3. AI Agent Responsibility

If you are using HumanStack through an AI agent or automated system (via API or MCP):

• →You — the operator of the AI agent — are solely responsible for all tasks booked through your API key, regardless of whether the booking was generated by a human or an automated system.
• →You must ensure your AI agent does not generate task requests that violate these terms. Ignorance of your agent's actions is not a valid defense.
• →You must implement appropriate safeguards to prevent your agent from booking harmful, illegal, or abusive tasks.
• →HumanStack is not liable for any action taken by an AI agent using the platform's API.

5. No Warranties

HumanStack is provided "as is" and "as available" without any warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the platform will be uninterrupted, error-free, or free of viruses or other harmful components.

6. Payments & Disputes

• →All payments are processed by Stripe. HumanStack does not store payment card information.
• →The service fee (5%) is non-refundable once a booking is confirmed.
• →Refunds for incomplete tasks are handled on a case-by-case basis at HumanStack's sole discretion.
• →Chargebacks or payment disputes initiated outside of HumanStack's dispute process may result in account suspension.

7. Reporting Violations

If you witness or experience any violation of these terms — including unsafe tasks, abusive behavior, or illegal activity — please report it immediately. HumanStack takes all reports seriously and will investigate promptly. Humans who feel unsafe may cancel any task at any time without penalty.

8. Governing Law

These terms are governed by applicable law. Any disputes shall be resolved through binding arbitration before any court action is pursued, except where prohibited by law.
